Exercise #4

FINAL CASE DISPOSITION:

You as the state parole agent, are to given the responsibility to determine if Matthew J. Carpenter is to be granted or denied a discretionary release from prison. Keeping in mind the information supplied in the scenario and the answers you have already provided in the three (3) previous exercises, evaluate the scenario and determine an appropriate solution or disposition for Matthew J. Carpenter's case. Your previous answers from the other exercises will be the justification for your decision-making process. Be very explicit in your decision-making process and use the work sheet elements as your support! You may only consider those activities Matthew has been involved in while a prisoner for the four and one half (4 1/2) years and the opportunities made available to him while in prison. You are not to include or consider the crimes committed, sentences previously received or anything prior to his imprisonment. If granting the discretionary release from prison you should consider the conditions of release under the parole agreement that will apply to Matthew. If you are denying his discretionary release you should consider when his next parole hearing date and those additional issues that Matthew needs to work on to improve his opportunity for parole in the future. It is recommended that you read the chapter on parole and re-entry which will give you additional insight. The intended reader of this disposition is the Chief Parole Supervisor.

Unlike the previous exercises asking you to identify, list and explain facts, assumptions and ideologies linked, this final disposition should be written in paragraph form and should show the true depth of your understanding of the concepts you have opted to include in this writing assignment.

If you are going to release the prisoner on parole:

1. Structure the parole over the total length of time until the sentence is expired.

2. List and explain the conditions of parole as you know them to be.

3. Supply the reasoning behind your decision to release.

If you are NOT going to release the prisoner on parole:

1. Estimate when the next parole hearing will be, six (6) months, one (1) year, or eighteen (18) months, etc.

2. Explain what things Matthew will need to continue working on to improve his opportunity for parole in the future..

3. Supply the reasoning why you are not going to release.

YOU NEED TO REED ALL EXTRA INFORMATION EXERCISE 1,2,3 AND TO DO A FINAL EXERCISE 4

Extra info :

Exercise #1

Part A - Facts from the case scenario provided relating to the parties involved in the case

  1. Since being committed to the jail term, Matthew J. Carpenter has violated few prison rules. This is an indication of improving behavior which can be supported by his moving from a high security to a medium security facility.
  2. Recorded evidence shows Matthew J. Carpenter to be high-tempered having been involved in fighting during his time in prison.
  3. Matthew J. Carpenter has not demonstrated a commitment to quit using illegal drugs such as marijuana after being caught in possession of the drug following the visitation by his girlfriend.
  4. He has admitted on several occasions to have used cocaine, crack, and heroin through counseling efforts of peer mentoring and group therapy.
  5. Matthew, who dropped out of high school, lacks the necessary education to sustain his livelihood after parole since he is yet to complete his diploma.
  6. The vocational training he has received while being in prison can be of importancein his life as far as earning a living is concerned. He can rely on this vocational training to find meaningful employment after parole. His job experiences working at the prison industrial are a demonstration that he can work in similar industries after parole.
  7. Having been an active participant of religious programs at the prison on Sunday morning in nondenominational church services, Mathew J Carpenter is showing credible signs of reformation.
  8. Matthew has demonstrated his commitment to completing his high school diploma and further pursuing an associate art degree

1b: Other facts/assumptions that may affect his overall behavior and decision making process but not specified in the scenario.

  1. Having dropped out of school at the age of 16 years and joineda local gang which he blames for his crime and drug behavior, it is most likely he would rejoin gang after parole due to their long period of association.
  2. Having a girlfriend who seems to support his drug use behavior by having brought him marijuana in prison, he is likely to continue with drug abuse after release.
  3. In most situations, ex-convicts find it hard to secure reasonable employment which could affect Matthews’ ability to secure a job despite having gained vocational skills during his time in prison.
  4. Due to lack of an immediate economic activity which Matthew could undertake to earn a living, he may be forced to terminate his desire to pursue higher education once out of prison.
  5. His willingness to educate fellow prisoners so as to undertake their education program could be a sign of commitment to reform

Teacher told me exercise 1 is perfect.

Exercise #2

Anger Management Program

In prisons, cases of fighting are very high that result in severe injuries and in some cases result in death. The use of anger management programs helps inmates overcome their anger issues that are the primary cause of these fights. Introduction of such a program helps the facilities minimize the number of deaths registered as a result of these fights. The programs also helps the inmates maintain a good record that helps them get a good parole and also helps them avoid indulging in violent behaviors in the society after their terms that would result in imprisonment. The program helps in the treatment of inmates anger issues that achieves the facilities objectives of treating and rehabilitating the inmates into becoming better members of the society.

Drug intervention programs

The number of people imprisoned as a result of drug possession is very high. At the same, many crimes committed by many people are associated with drug influence. As a result, the introduction of drug intervention programs helps the inmates overcome their drug intervention that helps prevent them from engaging in drug related crimes. Such a program also helps rehabilitate the inmates into becoming more responsible members of the society. Reforming the inmates also helps the facilities minimize the issue of overcrowding in prisons as the chances of rehabilitated inmates relapsing after completing their terms are very low. At the same time, such a program also helps the facilities achieve their objective of rehabilitating the inmates to discourage them from engaging in other related criminal activities in the future.

High school Diplomas and Associate Degrees

Such a program helps inmates gain the required expertise to land good jobs after completing their terms. With the knowledge and expertise gained from such programs, the inmates stand a high chance of getting jobs after returning to the society. With a good job, chances of the inmates relapsing to criminal activities are very low. The provision of education helps the facility achieve the objective of preventing crimes as inmates with good education have minimal chances of engaging in criminal behaviors because their education will enable them achieve good jobs after their terms.

Teacher told me: good work here identifying three (3) prison practices. You actually need 5 to 7 practices for the full number of points to be assigned and the ideology explained in the notes and textbook have to be linked to each of the practices. You have a good start but not there yet.

I see the last sentence in each paragraph is attempting to link it to the ideology but you can be much more direct.

Exercise #3

Workforce development, care for offenders

Matthew has participated in many prison vocational programs, and now works in the industrial arts area of the prison four (4) days a week. He has earned enough money to allocate himself small incidentals that he wants from the prison canteen (commissary). He participates in the religious programs at the prison and now lives as a God fearing man and an independent life and is no longer in association with bad friends

Losing or restricting visiting privileges

Straight away after Mathew had met his girlfriend, he was found to be in possession of cannabis and a knife. Due to this he was denied his visitation rights for three (3) months. He has admitted to be using cocaine, bhang and heroin in collaboration with his friends. Now through counseling efforts of peer mentoring and group therapy, Mathew has now completed several prison programs through counseling of mentorship programs which deals with drug intervention and anger management

Extending sentences

Mathew fought two times with another inmate, who purportedly made sexual advances toward him. He then faced over ten days of hard time and was also segregated for one week. The second time he was denied some days of good time for allegedly involving in crime with a fellow prison gang. The punishment was used to mould his behavior by making him become aware of the consequence that may follow upon committing an offence. Anytime Mathew committed an offence he was added more harsh days. This continuous punishment resulted into positive change as he could now indulge into activities which bring incomes. There has been a significant change in his attitude evident during group and individual therapy sessions.

Teacher told me This is better but you need to read the instructions and follow them. If you are confused we should meet right away.
