Facts
Rusk was found guilty by a jury of second-degree rape. On the material day of the incident, the
defendant met Pat at a bar where she and a friend, Terry had proceeded after a school reunion
party. Before proceeding to the bar, where the two met, Pat and Terry had hopped from one bar
to another a few times; both were driving in different vehicles. Rusk approached the two friends
and greeted them from where he continued conversing with Pat. When pat wanted to leave, Terry
was not willing to leave and wanted to continue partying. At this point, Rusk asked for a ride
home from Pat to which she agreed to, insisting that it was just a ride as a friend, to which Rusk
agreed to. When they got to Rusk's apartment in a city which Pat was not familiar with, he
requested her to come with him to the apartment to which Pat refused. It is at this point Rusk
went and picked the car keys and requested Pat to follow him to the apartment, to which she
agreed to. Once in the apartment, Pat was left alone as Rusk proceeded to take a shower and
never ran. When he returned, Rusk sat on the bed and invited Pat to come to bed from the chair
she was seated on after switching off the lights. When she first resisted, Rusk held her by the
hand to which she obliged and followed the defendant to bed. Once on the bed, the defendant
started to remove her clothes to which the plaintiff never resisted. She went ahead to remove her
pants at the request of the defendant. All this time, Pat didn't attempt to flee or call for help. She
also testified that the defendant did not threaten her with violence but spoke with an authoritative
voice as well as was persistence. When he put his hands on the victim's throat and lightly choked
her, the victim asked if she did what the Defendant wanted would he let her go. The Defendant
