mediator who should be a neutral party has both benefits and drawbacks. The main benefit of
using mediation is the lowered cost. Mediation is less costly to use in solving a dispute compared
to other methods such as litigation. Since it takes less time to solve a case through mediation, it
means that the parties would not waste much of the time in the case at the expenses of
performing constructive activities like going to work (Loots and Charrett, 2009). It is also simple
to prepare for mediation compared to a court case where one requires a lawyer. The solution
reached through mediation is similar to that reached through other resolution methods so long as
it is binding.
The venue for mediation is a place that is convenient for the involved parties, unlike
litigation where the parties must go to a courtroom whose location may not be convenient for
them. The method allows the parties to adjust the scope of the conflict. The allowance is not
available for trials where the proceedings are limited to the initial pleadings and rules
Even though mediation offers the parties benefits, it also has disadvantages. One
disadvantage is that mediators do not have the tools that are used in court to get to the truth. They
include tools that enable them to get people to give their testimonies and produce evidence. The
lack of these can hamper the ability of the mediator coming up with an accurate judgment. In
