Scenario: An employee is hired by Dream Massage to be a massage therapist. She is hired as an independent contractor and, therefore, receives no tax withholding or employment benefits. Dream Massage requires the employee to work a set schedule, provides her clients and all her massage products, and exercises complete control over how she does her work. In addition, when the employee shows up to work the first day, she is informed by her employer she cannot wear her hijab as it violates the company's dress policy.

The type of employment relationship that exists between an employer and employee or
independent contractor is majorly based on the type of control exercised over a person and the
terms agreed upon. In the case of the massage therapist hired by Dream Massage, for instance,
the employee taken on-board qualities of both an employee and an independent contractor. This
is based on the terms of contract laid out, where some are opposing to the idea of being an
independent contractor while others support it. First of all, the employer dictates the schedule
within which the therapist works. An independent contractor would have a flexible schedule
