Explanation & Answer

Please view explanation and answer below.

1. In the given scenario, there are a number of ethical and legal issues that could face
Broadway or affect them in future. That is if they go ahead and launch ‘Lucky’. The
first noted ethical issues is regards to their recruitment and selection process. It is said
that Kent got the job at Broadway as a result of his father knowing the President of the
organization.
The President of Broadway, by hiring Kent is guilty of cronyism. By definition, this is
the hiring of friends or family without fully assessing their qualifications and whether
they are the best suitable candidate for the job. The recruitment process of Broadway is
questionable and hence unethical (Wiley, 1998).
When creating video games, there is an ethical code of conduct. These principles guide
the creation of video games and ethical games are those that give the player an
opportunity to reason and reflect ethically. Looking at the games that Broadway creates,
it is evident that the games do not encourage ethical behaviour as they are characterised
by violence, sexual immorality and addiction (Lekka & Sakellariou, 2014).
The case study states that the target market is highly addicted to these games. Game
players are even described using the word ‘hypnotize’ which elevates and shows the
extent to which gamers, who are mostly young men are engrossed by these creations.
Broadway has a social responsibility to groom men who will be respectable and humble
members of society. The engrossment in these games does not encourage acceptable
societal behaviours (Lekka & Sakellariou, 2014).
Another ethical issues that is evident is the aspect of nudity and idolization of women.
The current global trend is focused towards feminism and the protection of women.
Femicides are common globally and a game that involves a woman stripping at each
level is provocative and could be seen as the perpetuation of the doctrine that sees

women as sexual objects. This makes it unethical and goes against the organization’s
social responsibility aiming to protect women and advocate for their rights.
In addition to this, the target audience for this game is mainly teenagers who are
between the ages of 13 and 19. Launching ‘Lucky’ could result in Broadway facing
legal lawsuits as it is illegal to share or provide pornographic materials to minors. In
the United Kingdom, it is illegal for a minor to be in ownership of pornographic
material. Broadway being the creator of the game is likely to face legal repercussions
(Geldenhuys, 2018).
Lastly, the game involves the aspect of getting coins back for the coins you put in. In
as much as this seems harmless, it could be seen as gambling and ultimately affect
Broadway legally. The legal age for any form of gambling is 18. Given that majority of
the gamers are below the age of 18, Broadway could face legal repercussions on the
basis of encouraging gambling in young children (Raisamo, Warpenius & Rimpela,
2015).
Given the above legal and ethical issues, Kent has very limited options. Regarding the
ethical issues, It is advisable that Kent remove any forms of nudity and find a different
kind of gratification for the players. This will ensure that feminist groups do not sue the
organization as women’s rights will not be violated and their bodies idolized.
Regarding the type of games, Kent could create games that are still entertaining but
helpful to the individual, for instance driving games have been proven to help with
motor skills and driving skills. Regarding the legal issues such as gambling, Kent can
enforce rules stating that slot machines would only be used by gamers that are aged 18
and above. These steps can help ensure that Kent and Broadway fulfil their legal
responsibilities and their social responsibilities.

2. The commercial use of sex, gambling and violence is defined as the use of sex,
gambling and violence for any form of monetary gain. In this instance, the creation of
video games containing these three is viewed as the commercial use of these three
concepts. Firstly, we will look at sex, in the United States, the Commercial use of
violence varies depending on what it is used for.
This scenario looks at video games, regarding video games, the commercial use of
violence is acceptable but in moderation and with limits. These limits are put in place
so as to ensure that nothing to violent is created. In addition, different states have
different legislation governing the presence of violence in video games. For instance,
in Michigan it is allowed in moderation regarding mino...
