The Resource Conservation and Recovery Act is a national law that was passed by the
Congress in 1976 in response to the growing concerns of industrial and municipal waste. In
particular, it was aimed at addressing the fear resulting from the increase in the volume of wastes
from industries. In many ways, RCRA is different from previous environmental conservation and
waste disposal legislation since unlike the latter; RCRA is more aggressive about waste disposal.
RCRA has a wider scope covering areas such as the protection of the natural environment and
human health, natural resource and energy conservation, recycling of resources to reduce wastes
and proper waste management through strictly set standards (Conservation & Act, 1976).
Subtitle C of RCRA is concerned about the proper management of hazardous waste
which includes those wastes that are environmentally harmful and can lead to health problems of
living organisms. The U.S Environmental Protection Agency (EPA) came up with a strict and
comprehensive program that ensures wastes that are dangerous to the environment are properly
handled from the time they are generated to the point they are disposed of, commonly referred to
as the cradle-to-grave program. EPC allows states to come up and implement own hazardous
waste legislation that guides generators of these wastes, transportation, storage, treatment, and
