- An analysis of the ethical concerns raised by the situation.
- Apply at least two different ethical theories to the situation to support at least two different outcomes.
- The paper must determine which ethical outlook as applied to this particular situation will result in the best legal outcome for the business.
- An explanation of at least three of the relevant areas of law that have been addressed in this course (e.g., constitutional law, contracts, anti-trust law, securities regulations, employment law, environmental law, crimes, or torts) and an assessment of the each area of law as it applies to the business situation identified.
- A recommendation to reduce liability exposure and improve the ethical climate or the overall ethics of the situation. Your recommendation must be supported by specific legal, ethical, and business principles.

Introduction
In our 21st-century complex global business environment, every size companies face
multiple ethical issues. It is the responsibility of these businesses to at least develop an ethical
code of conducts that each organizational member has to abide by and as well be able to put into
action. Ethics has a different meaning to different people; in general, it does boil down to the
basic societal right sense and wrong. It does involve making decisions within the business
context that aligns with senses of both right and wrong, together with the law. There are various
existing ethical dilemmas in our current business environment, but I will be dealing with side
deals (Harrington, 2014).
This principle guides a decision maker to do what is actually good and right. The doing
good priority results to ethical perspectives and to solutions considered possible to any
acceptable ethical dilemma. This principle as well relates to utility principle that states we have
to attempt to generate well over evil possible ratio in the world. The principle does stipulation of
the ethical theories that have to strive so as to achieve a greater good amount, the reason being
that most people tend to benefit from what is the best for them (Corley et al, 1984).
Business situation
Power generation issue, over the last several years, has increasingly been brought to the
forefront. The reason being majority plants represented by 45% tend to be using coal-based
technology. The facility is considered to be more cost effective and is capable of utilizing the
readily available natural resource, which is inexpensive. The electricity production process;

however, tends to be when the emissions are cable of creating side effects that are harmful. The
most notable do include nitrogen oxide, sulfur dioxide, and mercury and particle matter.
These elements combination contributed to air pollution levels decrease and has resulted
in local communities’ water supply contamination. Despite the negative environmental impacts,
it is the industries believe that it is the only economically viable approach towards electricity
production. It is as well because they often cite the exponentially increased natural gas prices.
Most are usually opposed to alternative source use establishment at the same time, because they
have been shown on how to produce electricity in small amounts and because it is not cost
effective. The areas have been problematic, in the creation of environmental law situation that is
becoming tougher in their emissions regulation from the facilities (Lieberman et al, 2016).
The industry is yet unable to create strategies that are effective for emission control and
have often been relying on designed schemes to benefit them. Trading in carbon credits is the
most notable. The plants that are above the legal levels, under this approach are capable of
purchasing credits from the others who aren’t pulling as much. They have the capability of
applying such kind credits to their own form of emissions. It ends up giving them different
guidelines following an appearance for the set standards.
The reality, however, is that the plants have not done anything to wards decreasing the
overall pollution amounts. They are utilizing a scheme instead, which is never curtailing on their
activities or on the negative impact it does have on communities. It has resulted in power plant
maintenance over course of time to the same levels of emissions despite the tougher
environmental regulations (Jennings, 2014).

I consider it as problematic, in how it shows how many facilities and the industry tend to
ignore the legal and ethical obligations that they have made to their stakeholders. These sorts of
challenges will create a situation if left unaddressed, where the existing and new regulations are
ineffective. There are as well possibilities that various communities health will end up suffering
more from such policies at the same time. It illustrates how there are legal and ethical issues that
have to be addressed within the process. So as to full be able to understand the challenges
overall scope, it will require careful examination of the variables and to the long-term impacts
that they will be having on the stakeholders.
