Landmark Case of McCullough v. Maryland brought out clearly the constitutional power
in the United States. This case came into being when the US government created the first national
bank and Maryland felt like the Federal government was becoming too powerful and they ended
up closing the national bank branch in Baltimore by imposing a yearly tax on banks created outside
the State (Plous & Baker, 1956). Maryland resulted to suing an employee by the name James
McCullough who refused to pay the tax, by indicating that Maryland had the powers to tax any
business in its State and they also claimed that Congress does not have Constitutional power to
