The death penalty in the USA is legal and is presently used by 31 states and the federal
government. The use of this law could be traced to the early American colonies. In addition,
United States is the only country among western nations that apply this law. However, the law
was struck down for some time in the in 1972 when one awaits trial in the prison. Nonetheless,
many states 1976 passed it again as the death penalty only applied to aggravating factors such as
multiple victims, rape or robbery. This law may have made many people argue that it is
oppressive and goes against the democratic rights, cost of corporal punishment is higher than
jailing them, and it denies one a chance to plea for change in future after committing such acts.
The law of death penalty in the United States despite being of importance as it curbs the
occurrence of such offenses but it is coupled with challenges in equal measure thus affecting its
application and critics to its application in the country.
In a democratic society, the death penalty is totalitarian no one is expected to die or be
killed because of corporal mistakes in the society. When the government through courts
prosecutes, sentences, convicts, and kill the plaintiff contravene their right to life as no one is
allowed even by the bible to not to kill others. According to Robbi Abraham Joshua Heschel on
many occasions says that not allured at the mistake, but everyone is accountable. Nowadays
system implements that as the citizens are the co implementers for the citizens’ state authorized
manslaughter, which is more similar to totalitarianism than democracy. In good democratic
environment even after on is found to be guilty their lives are spared and they are allowed to
serve their term of imprisonment without anybody being given the right to interfere with

the society in the name of punishment (Anckar, 2014).
Corporal punishment is barbaric in nature as the death penalty is an archaic, deteriorating,
and unkind and unusual form of punishment. This method of punishment even though is still
being practiced in the united states is usual unfair as it does not have a second chance even if one
has been found guilty and they have acknowledged that they had done such acts then it is of no
value since a person that has messed up once and has high chances of changing are not given that
