DB 1 Privileged Communication
According to Glosoff et al. (2020), privileged communication is the interaction between
two people in which the law recognizes a private or protected relationship. In other words,
privileged communication is a private conversation that must be kept in confidence for the
benefit of the communicator. Privileged communication must remain confidential even if it is
relevant to a case in court and, therefore, cannot be used as evidence. Additionally, privileged
communication assumes that a professional cannot disclose any confidential information even if
it is needed in a court of law without the client's consent. The privileged communication
originated in British common law, under which no individual could testify against another
individual in court. Consequently, the attorney-client was the first professional relationship to
gain the right of privileged communication. Over time, other professional groups, including
counselors and social workers, sought legislation to gain the right of privileged communication.
An excellent example of privileged communication was exhibited in a scenario where
Alicia, a professional counselor, provided counseling services to a female client called Jane, who
had divorced her husband, James, of 20 years, and the father of her three children. Jane, 45,
started experiencing symptoms of depression and decided to seek counseling assistance from
Alicia. Jane was also in a bitter custody dispute involving their three children. Alicia had several
counseling sessions with Jane where they discussed issues involving the couple's relationship
and how the father related to the three children. Alicia could involve the three children in some
