similarities and differences between; the English property law, Saudi property law and Islamic
property law when it comes; the topics of intellectual property, real estate, and trust laws.

1. INTELLECTUAL PROPERTY
English property law:
These are rules and regulations that govern protection and sharing and ownership of assets within
Wales and England. Intellectual property law is the branch that focuses on governing creations of
the mind by citizens. English law protects intellectual property; with most concepts having been
present for many years, this has led to three distinct categories which are Patent rights,
Trademarks, and copyright law.
According to the English law, a trademark can be defined as a name, word, phrase, image, sound,
shape, signature, logo, symbol, design or a combination of several of these elements. Every
trademark must be registered by their respective owners under the law before they can become
recognized or even stand to be contested for infringement under the law. Once registered the
possession of the trademark remains the owners for ten years before allowing room for further
renewal. The only other option is for the supposed trademark to have been in use by the owner
for some significant span of time rendering it a property of the user.
According to section 10 the Trade Mark Acts (1994), infringement boarders on use of logos or
symbols that are a complete replica or seem almost similar to an already registered trademark to
the extent of confusing the public. It is normally the task of the owner to file for infringement
upon realization; this is normally an easy process if the trademark under scrutiny is registered,
while unregistered assets rely on the law of passing off. Registration of trademarks in the UK
falls under the domain of the UK Intellectual Property Office (UKIPO).
Copyright law. This governs the exclusive use and distribution of works by their creators or idea
originators. This is barely a new concept when comes to English law with it being traced back to
the early 18th century’s Statute of Anne (1710). According to English property law, this rights
equate to control of distribution rights, reproduction, moral rights and public performance of the
