Property law is the branch of law that is concerned with tenancy and ownership of personal
estate and real estate within a given country. Different nations adopt different governing styles
and policies when it comes to dealing with property issues. In this essay, I intend to bring out the

English property law:
These are rules and regulations that govern protection and sharing and ownership of assets within
Wales and England. Intellectual property law is the branch that focuses on governing creations of
the mind by citizens. English law protects intellectual property; with most concepts having been
present for many years, this has led to three distinct categories which are Patent rights,
Trademarks, and copyright law.
According to the English law, a trademark can be defined as a name, word, phrase, image, sound,
shape, signature, logo, symbol, design or a combination of several of these elements. Every
trademark must be registered by their respective owners under the law before they can become
recognized or even stand to be contested for infringement under the law. Once registered the
possession of the trademark remains the owners for ten years before allowing room for further

symbols that are a complete replica or seem almost similar to an already registered trademark to
the extent of confusing the public. It is normally the task of the owner to file for infringement

while unregistered assets rely on the law of passing off. Registration of trademarks in the UK
falls under the domain of the UK Intellectual Property Office (UKIPO).
Copyright law. This governs the exclusive use and distribution of works by their creators or idea
originators. This is barely a new concept when comes to English law with it being traced back to
the early 18th century’s Statute of Anne (1710). According to English property law, this rights
equate to control of distribution rights, reproduction, moral rights and public performance of the
intellectual works. The is no registration requirement for

English patent law deals with the protection of inventions by citizens. This achieved by granting
the inventors the right to deny or grant permission to others; for using their invention. This right
is not permanent but rather runs for a limited period. Patents in English law are covered under
section 60 of the Patents Act 1977. Infringement on the patent rights held by an individual are
viable for contesting in a court of law if;
•
One uses or offers to use a process that was has been registered.
•
Making, using, disposing of, offering to eliminate or importing a patented product
•
Attempting to supply or supplying when it is apparent that the means used to formulate or
produce the items is patented.
