Direct evidence to establish a prima facie case--> evidence on its face of discrimination, for example documentation direct statements of discrimination
Circumstancial--> prima facile case can be established when 1) plaintiff establishes that they are a member of the protected class 2)they suffered an adverse employment action (like not being hired) 3) they were qualified for the position 4) the person replacing them was not in the protected class, similarly situated employees not in the protected class were treated more favorably
