Introduction

Establishment of Problem Solving Courts (PSC) in the United States of America was
done with the intention of addressing numerous problems that contributed to the criminal
behavior so that society is free from any jeopardizing occurrences. These courts trace their origin
as early as1989 when a Miami based judge become interested in special mode of handling drug
addicts through psychological and physiotherapeutic treatment as opposed to being confined into
prisons and cells. This led to the first creation of the drug court; forming a great milestone for
establishment of more than two thousand eight hundred thousand courts. Judith Kaye is accorded
due credit for her immense contribution towards creation, management and functioning of the
problem solving courts. With other similar minded liberals, she led to the foundation of Center
for Curt Innovation; which has been an advocate for establishment of Problem solving courts
(Berman & John, 2005).
Center for Curt Innovation has been at the fore front of designing and implementing
extensive research and development programs; with the intention of establishing Problem
solving courts totally different from conventional courts (Berman & John, 2005). The courts
were established under the following principles: availability of better information, community
engagement, continuous collaboration between legal officials and social service providers,
schools and victims of special problems, individualized justice links and accountability of the
offenders for both compliance and non-compliance consequences. Despite the fact of some
criticisms from a section of people, problem solving courts have helped in shaping the

Drug Courts
As well opined under the previous section, drug courts were established with the
intention of providing alternative sentencing solutions for individuals with special and chronic
rate of drug and substance abuse. Drugs courts do integrate key people such as law enforcement
agencies, mental health experts, prosecution officers and the judiciary; who together to ensure
that drug addicts find long lasting solutions to their problems in a community (Kirchner, 2014).
The following countries have created drug courts with the intention of curbing immense drug and
substance abuse problem in society: Australia, Canada, United Kingdom and America among
others.
Drug Courts in USA
Establishment of the first ever drug court in America was in 1989 in Miami-Dade
County. This was developed in response to the growing cocaine problem that was engulfing the
society. The following people were at the forefront for the establishment of drug courts in
America: judges Gerakd Wetherington, Janet Reno, Bennett Brummer and Herbert Klein. Drug
and substance offenders were to be helped to undergo specialized treatment as opposed to earlier
plans of them being convicted in prison cells. As of 2014, a comprehensive report by National
Association of Drug Court Professionals indicated that over three thousand courts are operational
across the fifty states in the United States of America (Marlowe, et al. 2016)

Rationale for Drug Courts

Most people do believe that drug courts are the most effective tools for intervention of
drug and substance abuse in America. This has been justified by the American Psychology
Association that indeed punitive measures do not solve the problem but instead worsen the
situation. It is true that over 60% of people who are released from prisons due to drug and
substance abuse end up returning to the cells; implicated in drugs (Belenko & Peugh, 1998).
Therefore, it was prudent having special system to address this sociological problem that was
