Abstract
The Supreme Court of the United States of America evaluates and analyses specific cases
in light of the various verdicts given by the lower courts to determine whether they have been
processed in accordance to the law, and its supremacy has been respected to the treatment and
manageability of the prisoners in the federal prisons. In the case of Sandin v. Conner in the year
1995, the Supreme Court of the United States changed how federal courts test prisoners’
procedures due process claims. Inmates are harmed by intraprison confinement as it’s not
representative of the experience of the prisoner and that’s why courts must know that such
confinements to be the experiences which are atypical and significant. The note argued that
atypical and significant standard, which majority of the lower courts applies, has been the result
of harsh results, specifically for inmates arguing that their assignments to intraprison
confinement levels which are higher followed little or followed no process.
Introduction
Conner, who was the respondent in the suit of Sandin v. Conner, supposed that the
solicitor together with other Hawaii prison officials denied him due process which was
procedural when an adjustment committee disallowed him to bring witnesses during a hearing
concerning discipline and due to his misconduct he was sentenced to segregation (Sbaratta,
1995). The Court of Appeals overturned the summary judgment which had been granted by the
District Court deciding that Conner had a liberty interest to stay free from corrective separation
and that there was a question of dispute whether he had been granted all the due process under
