Introduction
To protect the original idea of an individual, a law was initiated called the Copyright law.
Consequently, every country has a law that they have undertaken to preserve the unique work
done the creator of that work, and further giving the creator exclusive rights for the person to
choose how it is to be distributed or used by another party. Davis (2010) adds that these
exclusive rights are limited based on the exceptions to the copyright laws. One of the protection
rights, as noted by the requirement that makes this legislation controversial, is that it only
protects the original expression of the idea but does not protect the individual underlying
concepts. While this law is being supported by many who think that innovative ideas should be
protected, others have opposed it claiming that opinions are all built upon other ideas. Moreover,
because of the increase in digital media and the fact that to date, there are still some gray areas in
the rights protection, there is a definite conclusion that the copyrights legislation ought to be
reviewed. This study discusses the way in which copyrights have hindered creativity in the music
industry and how there is a need to reform it due to the emerging challenges that have been
brought by the digital media.
How copyrights operate
Furthermore, copyright is in itself a type of intellectual property, and it applies to some
specific creative work. In some jurisdictions, the copyrighted work requires fixing into a tangible
format. Typically, it can be shared among many other authors even though teach of these authors
should have rights to use the work. These multiple authors are customarily called, rights holders.
These rights commonly encompass reproduction, distribution, attribution, and performance
among others. Moreover, a further understanding of the copyrights legislations as they are,

indicate that these rights are territorial (Palfrey, Gasser, Simun & Barnes, 2009). What this

the regulated rules is that the copyrights remain effective for fifty to one hundred years after the
author dies. However, the year range differs depending on the state. Also, some countries require
formalities to establish copyrights. However, some countries just recognize the copyrights in any
work even without a formal registration for the work to be right protected (Rizk, 2010). With
this in place at the initial stages, things have changed because the development of the digital
media and computer technologies have led to the interpretation of the exception in the copyrights
legislations. This understanding helps to incorporate the new digitally integrated media. The
contention, however, emerges from the fact that, it is common for people to create original work
through borrowing from other works that had earlier been done. Therefore, when the copyrights
laws hinder a person from engaging in such activity where they build their creativity from
others’ actions, then creativity in itself will be impeded. In the next section, the discussion
reveals how creativity is hindered through copyrights laws.
