An employer was hiring employees after a strike.  On employment applications, they asked the potential employees whether they belonged to a union.  Was the employer engaged in an unfair labor practice?

Yes since right to organize is a form of freedom of speech and though they might solicit this information from employees they may not use it to influence their judgment about employee.
