A Motion for Summary Judgment (MSJ) is a petition for the court requiring a ruling to be
done such that there is no case on the defendant, due to lack of facts on the issue. The party who
comes up with the motion claims that either the case should not be presented before a jury, or the
ruling should be done favoring the moving party (Heilbronner, 2011). On the other hand,
motions for mistrial refers to the jury or judge trials that have been halted on a permanent basis
during mid-trial. In other words, the trials do not reach a successful completion but are declared
null and void before the verdict is returned by the jury or the rendering of the decision done by
the judge (STEIN, 2007).
