Description

4 to 5 pages

Since the enactment of the Affordable Care Act, there have been several lawsuits in the federal courts, and some have made their way to the Supreme Court. Not all of these cases are accepted for appeal by the Supreme Court and thus are settled at the appellate court. Analyze a recent appellant court case related to a health care legal case. If possible, find a case in your own federal appellate court. Discuss the following:

  • In what court did this case originate?
  • What is the law at issue in this case?
  • What are the arguments supporting the law, and what are the arguments to overturn the law?
  • Discuss the effect of this court case on health care delivery or operations. For example, will patient care be changed?
  • How will the operations of a health care organization or health insurance company be changed?

The paper should include at least 1 reference to research sources, and all sources should be cited using APA format.

Introduction
Since the Affordable Care Act passed and even before, the law was hugely
controversial. The policy defined the domestic principles of the Obama presidencies. It was
the more complex modification of the healthcare system since the sixties, and it considered
that medical bills are the most common cause of bankruptcy and healthcare is so expensive
that most of the population stays home when they feel sick instead of looking for medical
attention. The changes the Obamacare brought to the healthcare system were several different
policies intended to extend the coverage to people who are not poor enough to qualify for the
governmental programs for the poor and the elderly, but do not earn enough money to pay for
the premiums of the insurances or do not have health or dental plans coverage from their
employment. It is a legal right to have medical insurance, and if the citizen cannot afford it,
the policy made provisions to create different subsidies to help those workers that cannot
afford to pay the premiums. There are other provisions in the Affordable Care Act, such as the
fine to pay at the end of the year in the case of failing to have health insurance, or the
prohibition to drop patients from paid coverages in case of the onset of a chronic illness, the
mandatory use of the 80% of the premiums on actual medical care, among others. (Sherlock,
2017)
Religion and Contraception
One point of the Affordable Care Act that is highly controversial and had several
lawsuits is the obligation of the employers to provide insurances covering contraceptive
