HOW TO BRIEF A CASE FACTS: Pick out the relevant facts. Tell what happened. This should be about four sentences. Who? What? Where? When? ISSUE: What is the question that the case is asking? RULE: What rule of law comes from this case? This is usually an answer to the question in the issue. APPLICATION: Why was the case decided this particular way? Was it the facts? Was it a case that came before it? CONCLUSION: Who won.
Brief Instructions: 1. Must have name. Profess name. Class. Case Name. 2. I do not mind if you view example on the internet but for my class use your own direct word to explain the case and how it helps us understand the law. 3. Use the IRAC method. a. Facts: about four or five sentence telling us the background of what happened and how we got where we are. This includes relevant facts such as who, when , where, how. b. Issue: for my class this must be a question, meaning it starts with a capital letter and ends with a question mark. c. Rule: for my class the rule is the answer to the question which tells us about the law d. Application: this simply WHY. Why did the judge decide the answer to the question (issue) this way for these people with these facts. e. Conclusion: Who wins. Sometimes when we are reading we get so caught up in the details it is easy to forget to find out who won.
