FLSA - On December 1st, the federal annual salary threshold for employees exempt from overtime pay doubled, increasing to $47,476 from $23,660. Employees who make less than the threshold must be paid time-and-a-half for any hours worked beyond the 40-hour work week. Many employers will not be able to increase salaried employees' pay to the new higher amount so those employees will become nonexempt.

Employees will know they deserve better and it can cause companies to lose their valuable associates and can have a big impact on their business. Better benefits, hours, and showing appreciation to them can go a long way, and can definitely make a difference. It is important to have employees happy in their workplace, it has been proven that if an associate is happy and feel values at work they are more likely to preform better, and if this will affect associates then something needs to give back to them. Some of the recruiting challenges HR teams will face include impact to internal employees who will experience changes based on open internal positions, reclassifying existing positions, modifying current job descriptions, modifying current job postings, and what is the financial impact to the organization that may change overall staffing needs. The FLSA rule change will have a big impact on restaurants, call centers, and retail organizations where employees in lower leadership positions work more than 40 hours per week. In these operations employees making less than $47,476 will not get paid at overtime rates for worked hours over 40 each week. Many employers may not have the budget to manage this and could cause loss of business, loss of jobs, and if the company goes out of business the recruiters jobs will also be lost. Human Resources teams such as compensation, benefits, and training will also be impacted by the overtime rule changes as they will need to reforecast and possibly change compensation pay bands, employee benefits, cost of benefits, and how often training classes will be held based on how the FSLA overtime changes impact their revenue. If benefits change to either reduce or get eliminated this could have a negative effect on recruiters ability to attract the best talent in the job market. Lastly, many job seekers see leadership positions as a salary position and may view the hourly rate as not a true leadership position. However, for some the thought of making overtime pay if they put in more than 40 hours per week could also be seen as a positive for those looking to make more money when overtime is available.
