Without labor laws and agencies to enforce them, employees will be mistreated, and their rights
will be violated as well. It is for this reason that various labor laws have been established to
protect employees and ensure that they work in satisfactory environments. Nevertheless, some
companies or employers still violate these laws and subject their staff to workplace
mistreatment. The purpose of this paper is to identify an actual arbitration case involving a
company and its union, discuss the key issues in the case and also describe the ruling. A
description as to whether the ruling was a fair and the possible ramifications of the ruling are
also provided.

Unfair employment practices are major issues in the workplace today. They are
described as the issues that the employers or unions take to be illegal based on the National
Labor Relations Act (NLRA) and various other labor laws. While some NLRA rules apply to
the interactions between employers and unions, others have been made to protect employees
from unfair treatment by employees or even unions. Under this law, employees have the right
to come together to improve the employer’s terms as well as conditions. This labor law is
enforced by the National Labor Relations Board (NLRB), an independent federal agency that
works to assure workplace democracy as well as fair labor practices countrywide. An example
of a case arbitrated by this agency is Wal-Mart Stores, Inc. and The Organization United for
Respect at Walmart (OUR Walmart), a case that was decided on August 27, 2016.
