Facts of the case
The case involved a former secretary of Defense (1981-1985, Korb, who had been
employed at the Raytheon corporation. Importantly, Raytheon is a corporation that
majorly deals with the manufacturing of defense equipment such as sensor, military
hardware and sonar systems, satellite apparatuses among others (Amir & Weiss,
2018).After sometime, Korb was elevated to the executive position of vice-president of
Raytheon Corporation due to his hands-on experience on defense matters which he
gained when he was the secretary of Defense. Korb had a strong public image which
could help the corporation develop administratively and publically. While at the
corporation, Korb became a member of the Committee for National security (CNS) – a
nonprofit organization.
Subsequently, the case was as a result of remarks made by Korb that were critical
of the expenditure of Department of Defense. In relation to this, Korb had admonished
the Department of Defense to cut short their high spending on carriers and warships.
Accordingly, these remarks made by Korb at the press conference were not welcomed by
top officials from the Department of Defense who complained to the Raytheon
Corporation. As consequence, Korb was relieved of his duties and was denied a chance to
elucidate the remarks he had made at the press conference. Thereafter he was given a
choice to remain in the office as a special advisor and not allowed to make any future
public remarks without consent.
Regardless, Korb was not pleased with the current state of affairs as he could not
accept the terms of his demotion. Therefore Korb opted to file a case in 1987 at the
Massachusetts state civil court for the unjust demotion by the Raytheon Corporation.

Regarding the case, Korb cited the Massachusetts state laws that relate to civil rights as
well as the First Amendment of United States constitution to cement his position. On the
contrary, Raytheon sort for the case to be heard by a wider audience hence relocated the
case to Federal District Court that is situated in Boston (Korb v. Raytheon Co, 1989).
