Introduction
Arguments around plea bargaining exist and they revolve around whether it is a good
idea or not. Some countries do not allow this aspect of the deal, since they consider it immoral
and unethical. However, in the United States, plea bargaining accounts to 90 percent of all
criminal cases. Critics of this element believe that the practice coerces defendants to give their
right to trial resulting in irrational sentences. Hence, they argue that the practice should be
abolished due to failure to meet basic criteria.
Defining plea bargaining
Plea bargains are an agreement between the defendant and the prosecutor in a criminal
case where the defendant often pleads of guilty him/her to receive a lesser sentence or offense. In
other words, plea bargains are a form of establishing an agreement between the strengths and
weaknesses of a case but does not necessarily reflect a traditional sense of justice (Alschuler,
2005). Courts usually allow the respective parties involved in a case to work out a solution by
themselves without forgetting who the plea bargain serves best.
