Right to counsel implies that a person has the right to have an attorney present during their
trial whether they can afford one or no (Mulroy, 2016). The state bears the burden of appointing a
lawyer for those who cannot afford one. In the past, right to counsel meant that one was entitled
to a lawyer only if they had the means to pay for one which was unfair because of the high amount
of money attorneys requested for to take your case. Without a lawyer, it is hard for someone to get
acquainted because they are not aware of the ways things work in the courtroom. In my article, I
am going to focus on the Johnson vs. Serbs and Gideon vs. Wainwright cases. Johnson vs. Serbs
case was heard in 1938. Johnson appeared in court to answer to felony charges after he was found
with counterfeit money. He represented himself during the trial but was found guilty. He later
appealed under the 6th Amendment and was successful.
