The first example of the ethical challenges faced by the sides in the justice system can be
based on the side of discussing the ethical issues between the psychological therapist and the
therapist’s confidentiality with the client’s rights. When the client is in some problems with the
legal systems and the therapist is summoned by the court to present some of the client’s records,
the therapist is summoned to testify for the client. The issue comes when the therapist has to
disclose some of the information to outside sources like to the judge and the court. There are
standards where the psychologist is required to comply with the law dictating his code of
conduct with the criminal justice system the second instance is due to the regards of competence
in the workplace, this can be evident during the testimony on sentencing and during the parenting
decision making in court. One can conclude that parole and probation offices cannot be used as
an expert witness and when providing treatment and diagnostic testimonies and at some point
make psychological recommendations. The court faces ethical challenges with incompetency in
the side of the psychologist making wrong decisions that favor one side of the conflict. The
psychologist should be competent to give responsible recommendations.
According to researches, there is a negative attitude towards the insanity defense in the
criminal justice system. The legal justice system views the insanity claim as a prevalent defense
where the highly influential individuals view to escape punishment after committing a crime.
