by significant variables like race, gender, and the class. Furthermore, certain aspects including
the mitigating and the aggravating factors are also used by the judge and the jury in the
sentencing process to ensure a fair application of the death penalty. Immediately after an
individual has been proved guilty to a given offense, a ruling judge thus considers these issues
during the sentencing process as mandated by the law(Kadish, Schulhofer, & Barkow, 2016). In
the process, all relevant factors are identified, and therefore, the significance of each aspect is
considered to make a correct ruling about a defendant. The appropriateness of the sentence is
thus determined at the terminal phase when such determinant factors have been singled out and
balanced by the judge.
Roles and responsibilities of the judge and jury in the sentencing process
Although both the judge and the jury take part in the sentencing process, each party plays
its role as demanded by the constitutional law. To begin with, judges always decide on the
punishments posed for the criminals in the capital punishment cases. The jury, on the other hand,
determines whether to suggest a life or death imprisonment. Judges take a role of presiding over
