In essence, the least democratic institutions in the country are allowed to overrule the

philosophical underpinnings and public policy influences of other democratic institutions. In this,
the U.S. Supreme Court has the power to make decisions philosophical or public policy
preference not only when it holds a different opinion but when there is a substantial conflict
between the law and the constitution. When the conflict is apparent, no other institution or a
person can define or enforce the limits apart from the justices of Supreme Court. When the
judges impose their public policy preferences or philosophical underpinning, the whole system is
