1.I think insureds should be able to file a lawsuit against insurance companies for denial of a claim. Customers have insurance for a sense of relief or a “security blanket” in the case of a event. If the denied claim was found to be “in bad faith or without proper cause”, I think insurance companies should be punished. The stress involved in any event can be hard for any individual, I think insureds should be able to sue for any distress (within reason) but also, punitive damages because this can deter insurance companies from doing this again.

I don’t believe the correct remedy is to sue for whatever benefits the policy would provide because I feel like insurance companies would deny claims more often. If insurance companies had the fear of being sued for more than their policy benefits, I think they would be less likely to deny claims unless needed because they found something that would support their denial.

2.I believe the insured's should be given the option to be able to sue the insurer if the insurance company denies their claim "in bad faith and without proper cause." The insurer should uphold by what was written on the policy. If they were to deny or reject their claim, that would show negative connotations of what kind of business the insurer is trying to run. If the insured is unable to voice their opinion against the insurer, then the insurer would still be able to just write business for quick money
