Both the state and the federal governments have the aim or goal of observing the
principles of the social contract when they issue punishments for criminal and civil violations
or infractions. The social contract postulates that individuals tend to relinquish unassailable
rights, such as the right for personal revenge, retribution or taking the law into their hands, so
that they may live in a society which is presumed to offer remedies when they have been
wronged. People left the mentality of hunting and gathering to form a society so that they would
receive better protection from better resources and large numbers. Hence, the state and the
federal government have the responsibility to ensure that those found to have committed
wrongdoings are punished.
