Case studies on privacy breach
1. Chinese residents’ vs Yahoo! And Yahoo Hong Kong
This is a case presented in an American district court about violation of user privacy. This case
involved the Chinese people and the Yahoo Company in Hong Kong that breached the electronic
communications privacy act (ECPA). This act was introduced in the US hence the ambiguity of
its relevance outside the country. The Chinese residents have gone ahead and decided to present
their case on the American soil so as to avoid any technicalities.
This act was an amendment of the previous wiretap act that only applied to local
communications only and restricted oral and wired communication interception. Despite the
amendment of the wiretap act, the new ECPA act did not allow protection of people outside the
United States. Therefore, the Chinese people are not automatically accorded justice by the US
court because the act does not protect those outside its borders. However, the company will still
face legal issues because it operates from servers located within the jurisdiction of the Act
(BRILL, 2016).
2. Stacy Guin against Brazos
The higher education service corporation has neglected the plaintiff’s personal information and
allowed it to leak to others. A company’s employee named john wright whose is their financial
analyst was burglarized and the laptop containing the plaintiff’s data was amongst the items
stolen. The Brazos Company sent wholesome notification letters to all their clients since it was
required by the law without knowing whose data was involved in the breach. According to Stacy
Guin, it’s the company’s obligation to safeguard all the information disseminated by their clients.

When such a case is presented to a district court, the most likely outcome will be the defendant
compensating the claimant for allowing data leak through professional negligence. For the court
to act in the plaintiff’s favor, there must be proof that the company failed to act, there should be a
clear duty to act, prove a direct relationship between failing to act and action happening, prove
harm was done to someone. The company should not have allowed their employee to take home
any office equipment without proper notification and security procedures being enacted. Being a
big business, the Bravos Company fulfills the first three requirements for the case while the last
one is contentious. Therefore, if the court can prove that Stacy’s data was on the stolen
computer, then they can prove harm was done and make the company compensate her
(MURRAY, 2018).
3. XY magazine case
This case involves the defunct magazine company that targeted you people. They required users
to input their subscription data and access their magazines. The magazine company promised not
