1. In reading the case of Bearman v. Notre Dame I find it very interesting that the court’s decision was overturned after Christenna Bearman’s appeal in arguing that she was a business invitee of the University of Notre Dame. Bearman’s argument was that she was a business invitee of the University of Notre Dame therefore it was the responsibility of Norte Dame to protect her from injury. I can see the argument that Bearman is trying to make as she was involved in an injury that still occurred on the property of Notre Dame after a game was over however it is just not feasible for Notre Dame to be able to guarantee the safety of 70,000 plus fans especially after a game is over. It’s unfortunate that Bearman was injured by a drunk fan however, there is some level of responsibility she also needs to be held to as she shouldn’t have attended the game if she felt that she was in such danger. My experiences at college football games where fans have been consuming alcohol have been interesting to say the least as I have witnessed multiple fights at the University of Colorado before, during, and after the game. Personally, I take the approach of always watching my surroundings when I am at a college football game because I know the dangers that come with it. What is more concerning is the liabilities that these colleges and universities must face because a lot of dangerous and harmful situations occur on the property of these colleges and universities where people can get seriously injured. If a situation occurs on a college or university’s property, then it is their responsibility to have to prove that they are not liable for the acts of others outside the stadium just like the example of Bearman v. Notre Dame. What I would like to see more of is colleges and universities banning the sale and consumption of alcohol at college football games and even other major sporting events that they hold. I just think it’s a bad idea to even allow the sale of alcohol on a campus in which most of its students are underage and cannot legally purchase alcohol. Yes, I understand that this would ruin it for those that are of age and can legally purchase alcohol but my rebuttal to that is they should also be responsible enough to act like an adult and go a few hours without having to consume alcohol at a sporting event. The difference between negligence and intentional tort is negligence deals with not providing the proper guidance or care one needs in a situation where intentional tort is when a horrific act is carried out on purpose towards another individual. In the court of law trying to determine the difference between both negligence and intentional tort and how it applies towards a case can be a very important determining factor. With almost any sports there are dangerous situations that people put themselves in to be able to enjoy attending their favorite team or even participate in playing their favorite sport. In most cases these dangerous situations come with product warnings, so people know what they are getting into before an issue arises. What I purpose a sport manager should do to help implement product warnings is having people who attend a sporting event sign an electronic waiver when purchasing their ticket explaining to them the dangerous situations they may face, and that the organization is not liable for any injuries. I know this would be a huge inconvenience towards fans however, at the end of the day it will not stop fans from attending a sporting event and will ensure that an organization is not held liable for any safety concerns. Moving forward I could see liability issues impacting my career path as I want to be in the sport industry teaching kids how to play hockey. Hockey can be a very physical sport at times especially if you don’t know how to play properly. In choosing this career path I would make a huge effort to let parents know the dangerous situations that come along with playing hockey and ask them to sign a waiver to ensure that if anything happens myself or the organization is not at fault for an injury sustained towards their child. 2. can only imagine the many different liability concerns that universities deal with on a regular basis. Just because incidents happen on the grounds of a university shouldn’t make the university liable for damages, and they shouldn’t be held responsible. I can see where Ms. Bearman is coming from in thinking that she should be safe in attending a college sponsored function, but on the other hand, I don’t feel the university should be held liable for the actions of an individual that does not represent the university nor have any affiliations with the university. I have seen how quickly tempers and behavior can get out of hand when alcohol is involved. People lose their inhibitions and don’t think clearly when they are drunk. “Crowd mentality” sets in and fans get caught up in the excitement and can act obnoxiously to say the least. I’ve attended games where drunks have started both verbal and physical fights that probably would have never happened if they had been sober. I think we all have a certain expectation of safety at public events, but sometimes bad things happen no matter where you are. The chances of accidents or fights increase when alcoholic beverages are readily available and consumed. An intentional tort is when someone intentionally sets out to harm another on purpose. Revenge is a classic example of an intentional tort. When someone decides and plans to harm another person and actually carries out their intent. Negligence is when something happens due to careless acts or lack of training and/or lack of correct equipment being on hand or available. I know that a lot of little league teams often times get older and used equipment donated to them and the coaches and managers should carefully inspect the equipment before allowing children to use them. Safety should be the number one concern and if the equipment doesn’t meet the current standards, they should not be used by team. I know that many parents prefer to purchase new equipment for their own children that can be used for several years. Most sports can be very dangerous, and the various equipment should meet or exceed safety regulations. I hope to one day be a beach wedding planner, but I really can’t think of any product liability issues that I would run across. I will personally inspect all equipment to be used and will ensure that my client’s safety will be a top priority. 3.
