Jennings Case Discussion

Read the opinion (SEE LINK BELOW) from the United States Court of Appeals 4th Circuit in the case of Jennings, et al. v. University of North Carolina, et al. (2007). The plaintiffs bring this case under federal law (which is what we have here in Chapter 6), under Title IX (which we'll get to in Chapter 8), and common law. They all really end up at the same place, so don't get caught up in the federal statutes.

This is an interesting case because it shows the complex nature of a sexual harassment claim. This case has:

1) a majority opinion (this is the actual decision in the case) Pages 1-21. This is the part you actually need to read, but don't get bogged down in legal wording regarding procedural issues that you don't understand. Just look for the good discussion of the sexual harassment claim. I encourage you to read the concurring and dissenting opinions if you are finding this interesting.

2) a concurring opinion (this is written by justices who believe that the case was decided correctly, but had different reasons for coming to their conclusion), and

3) a dissenting opinion (this is written by justices who believe that the majority of judges came to the wrong conclusion and this opinion states why they hold this belief.)

Notice the number of defendants in this case - it isn't just the University of North Carolina and the coach. There are others being sued based on a theory of respondeat superior liability.

Personally, I think the case was not decided correctly. The court's general decision to

dismiss the case was based on it not being sufficient and pervasive enough to be termed as sexual
harassment under Title IX (Stader, et al, 2014). My decision has been summed up from all the
facts of the case and the factors of establishing whether or not the case is pervasive and severe
enough to be called sexual harassment. Those factors included: One, the coach and Jennings
