Security breach is a major area of concern in the current world. Therefore, the American
government enacted various laws at state and national level to help safeguard data by
determining the party’s privy to consumer information. The laws governing access control are
based on the notion that people have an expectation of confidentiality unless the right is
eliminated or dismissed by disclosure, statue or agreement. The laws control information access
in various industries such as healthcare and financial industries. These laws impose
responsibilities to organisations to prohibit deceptive and unfair practices and to safeguard the
intrusive use of client data when considering employment, credit and insurance eligibility.
One of the laws governing access control is the Health Information Portability and
Accountability Act (HIPPA). HIPPA provides protection for sensitive health information. The
law allows consumers certain privileges over their personal health data (Gina, 2013). A
consumer can obtain their health records, accurate information on their status and allow certain
parties access to this information. The law sets guidelines on the parties allowed to access a
patient data whether written, electronic or verbal. The privacy law is strictly applicable to
covered entities and these include healthcare providers and health plans. A consumer is allowed
to file a complain the health provider, insurer or government in case they feel their information is
not safeguarded. The complaining needs to be written and delivered through fax or mail within
180 days.
