Organizations are prohibited from discriminating against persons with disabilities in the
workplace under the Americans Disability Act. Disability includes any severe illness and
physical and mental issues (U.S. Department of Labor, 2022). Walther sued her former employer
for age discrimination and the inability to accommodate her Pedophobia or fear of little children.
She filed a complaint under the ADA against her employer
in the case at hand.
However, when it comes to this case, the plaintiff did not have a valid claim under the
ADA. To be covered by the ADA, an employee must be able to perform the fundamental tasks of
their work. Employers are not required under the ADA to generate new positions for challenged
employees as the plaintiff was demanding. As a result, an employee's dissatisfaction with the
outcome of the accommodation consideration does not qualify them for legal recourse (Alerts,
2015).
Based on your academic analysis, what kind of proof would be needed for someone in her
position to convince the court that her lawsuit was viable and she needed reasonable
accommodation?
For her complaint to be successful and for her to be eligible for benefits, she must present
evidence or proof that there has been discrimination against her under the ADA. Also, she has to
present valid proof showing that she has a condition, which must be specified under the ADA.
