If the Appellate court decides that the trial court committed a reversible error by
including evidence obtained from a Fourth Amendment violation, the case is taken back to the
trial court to review without the inadmissible evidence. If the case cannot be pinned without the
inadmissible evidence the defendant may go free. A reversible error refers to sufficient errors
made by the trial court such that the appellate court grants a reversal of the decision or judgment.
When an Appellate court rules that a reversible error occurs due to violation of the defendant
constitutional rights, the appellate court may reverse the decision or judgment made by the trial
court and order new case trail based on term and conditions that the appellate court deem just,
such as the omission of inadmissible evidence during the trial. Inadmissible evidence refers to
the evidence that cannot be used in a criminal trial against a defendant (Jennings, 2018).
An illegal search and seizure especially when obtaining evidence may be actionable and
the law enforcement officer may be subjected to prosecution, but such a case where a law
enforcement officer is prosecuted is often rare. However, during the case review there are some
exceptions to the exclusionary rule that can be used. For example the officer can claim the
common-law defenses, such as the claim of good faith. The claim of good faith is not based on
the personal intent of the law enforcement officer. Instead, the officer is subjected to qualified
immunity, where the rule of law does not indicate clearly that the unlawful search violated the
Fourth amendment, or where the officer had an impartially reasonable belief that the unlawful
search violated the defendant fourth Amendment was sustained by probable circumstances or
cause (Thomas, 2018).
Often, the defendant subjected to unlawful searches is disreputable individuals' towards
whom the court is unsympathetic, or who are unable to sue for the illegal search. As a result the
