are met. For example, there must be malice aforethought and premeditation involved
and must be a deliberate act. There are a few things that fall into this category; such
things are the death of a human being by arson, treason, aggravated sexual assault and
assault, as well as others. Basically, if someone is killed during the commencements of
a federal crime, it is also considered 1

degree murder. Such charge will include a
punishment of death or life imprisonment.
One example of the mens rea would be that someone would have planned out a
murder and fulfilled this act by setting a house on fire knowing that the targeted
individual was home and was killed because of this fire. This would be a prime example
of premeditated with malicious. Another example would consist of willful act of shooting
someone in the streets. Waiting behind a bush for the target to stroll by and shoot,
shows a willful, deliberate, and premeditated.

degree murder would any killing that has
no premeditation or malice involved. Such charge carries a life imprisonment to any
number of years that justifies the criminal act. One example would be if there was a
fight at a bar, and let’s say that a man killed someone in defense of his friend that was
being brutally attacked. Here, that is no premeditation of committing the act of 1
st
degree

Manslaughter is considered in a killing of a human being when malice is not
present during the criminal act. According to this section, there are 2 type of
manslaughter. First, voluntary manslaughter is a sudden act or in the heat of passion.
Second, involuntary manslaughter is considered when death occurs during a criminal
act not amounting to a felony. Voluntary manslaughter carries a fine and no more than
15 years imprisonment or both and involuntary manslaughter carries a sentence of
either a fine and no more than 8 years imprisonment or both.
On example of voluntary manslaughter would be in the case of a lovers triangle.
This is what my father was charged with due to killing a man that he was fighting with.
This man was at his wife’s house when he arrived and was defending himself when this
man pulled out a knife and attacked him. His state of mind was clouded by drugs and
alcohol and could not comprehend his act at the time the criminal act was committed.
One example of involuntary manslaughter would be when two men are fighting and one
man punches the other in the face and that man falls and hits his head on the concrete
cause brain damage or some form of internal bleeding and death occurs due to the
trauma of a head injury. This man dies from a head injury that was cause by fighting
which is not a felony act. Felony

In the State of Washington, it is considered to be vehicular homicide when the
victim is hit by a motor vehicle and death occurs within 3 years due to injury sustained.
One is guilty of vehicle homicide if they struck a person with their vehicle while under
the influence, driving recklessly, and or with disregard for others safety with death being
the result.
