Question 1
Mens rea refers to an individual's intent towards committing a crime. Stereotypically,
there is always a specific intent that leads to committing a crime; however, this is not essential in
every circumstance. For instance, whenever an individual commits a crime that is categorized as
a strict liability offense, then the criminal intent component is not considered. On the other hand,
actus reus the act accomplished by an individual that can be ascertained to be a criminal act
(Beecher-Monas & Garcia-Rill, 2017). Actus reus is commonly the physical enactment of
criminal activity. In this category, it is essential to note that if the carried out physical action is a
reaction or a response, then the deed does not count as a crime. Apart from strict liability crimes,
all other forms of crime require mens rea as well as actus reus. Lack of mens rea implies that the
suspect cannot be guilty of the ascertained allegations that need criminal intent.
Question 2
The company murky mining Inc. is a corporation. According to the law of separate legal
entity, a company is a legal entity that has its rights, liabilities, and obligations. Under civil law
remedies, the wrongdoers are held liable and given the designated punishment. Therefore, it is
difficult to say if mike could be held responsible for paying the charges. If any offense is proven
under mike's name, he would be liable for the punishment as decided by law (Cappelletti, 2019).
