John Gardner's case is a classic example of how failed the Criminal Justice system was in
this case even as the perpetrator admitted to two first degree murders and previous reports
showing a man under state supervision. Gardner admitted at attacking, raping, and then killing
17-year-old Chelsea King and a 14-year-old girl named Amber Dubois, who was killed as she
was on her way to school (John Gardner In His Own Words Pt. 1 I could not stop
myself [Video], n.d.). After investigations were conducted, law enforcement discovered
Gardener's semen on his victim's pants, and on being arrested, Gardner admitted to committing
both crimes as a way of avoiding the death penalty.
In my view, Gardner was supposed to be sentenced to death. This is a testament that the
implementation of the death penalty is an issue in California. The reason is that Gardner had
served five-year parole in 2000 for using violence and sexually molesting a young girl (Wilkens,
2016). For one, the families of the victims cried foul because the perpetrator had a severe
criminal record involving the rape and assault of his victims. Moreover, Gardner had been
arrested in 2003 with mental health problems and placed in a mental health facility because he
was considered a threat to the public and himself. He completed his parole in 2008, having
severally violated the terms. This was a dangerous person that was allowed to roam freely for too
long, and as in the parole report, he is considered a "Mountain lion" (Wilkens, 2016).
In my view, the defendant was given too much of a light sentence despite confessing to
carrying out two-second degree murders of innocent girls. In a video where he talked to the
media for the first time after he had avoided a death penalty, Gardner laughed it off and even
offered to meet the parents of his victims (John Gardner In His Own Words Pt. 1 I could not stop
myself [Video], n.d.). Gardner had also led investigators to the crime scene where the bodies of
