XY Company entered into a contract with a Thailand company to export palm oil to Thailand
for delivery to Russia. The Malaysian government prohibits exporting any Malaysian revenue
to Russia. When XY Company failed to send the amount of palm oil as promised to the
company in Thailand, the Russian company sued XY Company.
Advise XY.
Issue:
Whether the Russian Company can sue XY Company or not?
Section:
According to the Section 24 Contract Act 1950, stated that the consideration or object of an
agreement is lawful, unless
(a) it is forbidden by a law;
(b) it is of such a nature that, if permitted, it would defeat any law;
(c) it is fraudulent;
(d) it involves or implies injury to the person or property of another; or
(e) the court regards it as immoral, or opposed to public policy.
Contract against the public policy - the interest of the state
In each of the above cases, the consideration or object of an agreement is said to be
unlawful. Every agreement of which the object or consideration is unlawful is void.

Fact of case:
The plaintiff had agreed to lease a palm oil building, machinery and assets on a piece
of land situated in Johor (the property) to the defendant for a lease period of three years and
14 days for a monthly rental of RM250,000 (the lease agreement). The lease agreement
