In determining whether a child of 16 years of age committed a criminal offense, a
judge must consider various issues of concern. One of the issues which this case presents
includes the aspects of the type of crime committed and the age of the child. In some states.
Children of 16 years of age and above are subject to be tried as adults (Bechtold & Cauffman,
2014). This conclusion comes from the notion that most states in the country consider adults
as a person who has attained the age of 16 years. While the age factor may not act as the
primary issue of concern, the child may have committed a specific crime which requires
trying as an adult. In some states, children as low as the age of 13 years who may commit
serious crimes such as homicide among others may be subject to trial as adults.
On the other hand, considering the age of the child remains another vital aspect of the
case. For instance, the judge needs to weigh the age of the child in relation to the adults and
the juvenile trial. The cases which qualify for adult trial may not be tried in the juvenile
courts because of their magnitudes. In relating the decision to Saint Leo`s core values, this
section highlights the concept of personal development. The decision taken by the judge
should be inclined towards ensuring that the affected child receives not only a punishment but
a form of guidance to guarantee personal development ion the community.
Restorative justice refers to the concepts of bringing together the offenders and the
victims of a given crime committed in the past. The primary role that restorative justice plays
include seeking to bridge the gap between the offenders and the victims. Sometimes, the
offenders who committed a crime against an individual person may feel guilty of the actions
performed in the past. As a way of reducing or eliminating the possibly existing gap and
grudges between the offender and the victim, experts in the field of criminal justice bring
together the two parties together as a way of reconciliation (Van Ness & Strong, 2014).
