Juvenile Justice System
The juvenile justice system is the respective formal arrangement made by governments to
deal with children whose behaviors are against the law by taking cognizance of their rights and
best interests. Although juvenile criminal cases are handled differently with cases involving
adults, some major weaknesses make this strategy less useful because it does not consider
various characteristics of a child. The three essential factors that should guide the juvenile justice
system are age, mental and social development, and parenting and upbringing.
The first strategy of dealing with juvenile criminal cases that consider age and parenting
are the child’s general developmental considerations while deciding the appropriate response.
The juvenile system should take into consideration the developmental needs of a child. From a
developmental perspective, the nature of the child’s interaction with the correctional system
impart them with acceptable values. However, the child’s experience with the system is
indifferent, impersonal, and thoughtless; the experience will have an opposite effect on the
expected impact. As a result, the justice system should balance between permissiveness and
punishment to intervene in the children's behavior.
The second most effective strategy is the use of community-based sanctions rather than
using institutional alternatives. From the development perspective, prolonged detention in an
institution setting harms various developmental phases of the child. In this case, the children
adapt to an environment that is different from those they are expected to return to after the
detention. As a result, incarcerated children get worse. These problems caused by institutional
detention can be solved by using community-based sanctions.
