FALSE MEMORY SYNDROME 2
False Memory Syndrome
False memory syndrome is a condition that mainly occurs as a result of traumatic
episodes by memory. The state is most common due to sexual abuse that is false, but the person
strongly believes. The false syndrome has its adverse effects in different institutions and majorly
in the civil courts. The false syndrome condition has adversely affected the civil courts in that it
alters the use of eye-witnesses testimonies. As a result of this, civil courts tend to lag in
administering their legal duties.
Firstly, the memory does not provide an actual representation of the events as they
unfolded (Brainerd & Reyna, 2015). The condition mainly hinders the storage of information in
the long-term memory, and as a result, the information is stored in the short-term memory. As a
result, when one is presented in a civil court to testify on the events that happened, the eye-
witness tends to give partly correct information. This situation can be brought from source
amnesia that makes the images in the brain be divorced from the context of the evidence. The
condition leads to the eye-witness not determining correctly the sources of the images, and the
situation renders the cross-examination of testimonies ineffective.
False memory syndrome can lead to the eye-witnesses in courts make some life-altering
decisions. In severe cases, false memory syndrome can lead to some taking away their life. If
such an occurrence happens to an eye-witness in a civil court, it can slow down the court process
or, in some instances, lead to dropping the case. The situation is very detrimental as some severe
cases are not dealt with satisfactorily, leading to ineffectiveness in justice administration. It calls
for the affected person to undergo therapy before testifying in court cases (Brainerd & Reyna,
2015).
