assignment for you. Chief Draper wants you to review a specific case and assess the arresting officer’s conduct.
To prepare your report, you consider certain factors, such as the societal factors that may have influenced the
suspect’s behavior, the role of the government in terms of protecting both society and an individual’s rights, and
the ethical standards that govern law enforcement.
1. Select one of the crimes Jones has been previously charged with (e.g., public drunkenness, resisting arrest,
possession of a controlled substance, felony larceny, or prostitution).
a. What type of crime is it (misdemeanor or felony)?
b. How is this crime defined in the state in which you live?
c. How might societal factors have influenced this suspect’s crimes?
2. Analyze how the purpose of government and the social contract might protect the rights (e.g., safety and
security) of the suspect in this case.
3. Compare the various roles Officer Marconi must play in this case. Consider that Marconi must enforce the law
and protect the suspect from harm at the same time.
4. Analyze how a law enforcement officer’s actions might be influenced if he or she is arresting an “unsympathetic
suspect or victim,” specifically a suspect or victim who the officer has arrested before or who engages in a high-
risk lifestyle, such as substance abuse, drug dealing, or prostitution. Justify whether Officer Marconi acted
accordingly.

Count I; and Rape, Count II; and pronounced guilty by the
Superior Court, Maricopa County, Yale McFate, J., entered a
judgment of guilty sentenced to serve from twenty to thirty
years on each count, to run concurrently. (Arizona, 1965)
Vignera v. New York, the defendant made oral admissions to
the police after interrogation in the afternoon, and then signed
an exculpatory statement upon being questioned by an
assistant district attorney later the same evening.
Westover v. United States, the defendant was handed over to
the Federal Bureau of Investigation by local authorities after
they had detained and interrogated him for a lengthy period,
both at night and the following morning. After some two
hours of questioning, the federal officers had obtained signed
statements from the defendant
California v. Stewart, the local police held the defendant five
days in the station and interrogated him on nine separate
occasions before they secured his exculpatory statement.
State v. Jones, 401 P.2d 721 (Ariz. 1965) (Arizona, 1965) in
this appeal the defendant brought up several points of law:
Rule 236, Rules of Criminal Procedure, 17 A.R.S. (1956); His
case did not go to trial in a timely manner. He thought there
were objectionable, prejudicial and redundant, and
unnecessary words used in the trial. That the verdict is
unsupported by the evidence. That there was prejudicial error
committed by the deputy county attorney when he argued
before the jury that the victim acquiesced in the act due to
fear. Admission into evidence of his written confession was
error for the reason that he did not have an attorney at the time
the statement was made and signed. In all cases the court
