Do you see any issues that are ongoing with regards to Mergers and Acquisitions and anti-
trust?
The anti-trust laws comprised of a collection of federal and state government laws that
help regulate the conduct by organization and business mainly focused on promoting competition
to the benefits of the consumers. In the USA, the Anti-Trust law comprises of three main Acts,
namely, the Sherman Anti-trust Act 1890, Federal Trade Commission Act, and the Clayton
Antitrust Act (U.S Department of Justice, 2017). Merger and acquisition are vital business
processes that aim at combining two or more companies into one, where one company acquires
the shares of the other company or buy-out a company. In most cases, mergers occur between a
large and stable company buying a financially struggling smaller company with the intent of
growing the market share or diversifying the market. Similarly, mergers and acquisition promote
the ability to facilitate organizational efficiency while increasing the profitability of merged
companies. Besides, mergers augment healthy competition in the market-leading to benefiting
the consumer through competitive prices.
Based on my opinion and the understanding of mergers and acquisitions and the anti-
trust, I do not foresee any ongoing issue because the primary aim of the anti-trust law to
complement the competitive environment for the benefits of the consumers and aspect provided
for by mergers and acquisitions. However, mergers and acquisitions need to be well-thought-out
before the relevant bodies approve the process to avoid a situation where the merger could lead
to the monopoly of the market, whereby a dominating company buys out the smaller companies
leading to unhealthy competition.
