Facts of the case
Edward, a laborer at Vampire Falls, was sent to Vampire Falls Cemetery to install a row of
headstones along the property line between the Town Park and the neighboring property, owned
by Bella. He dug holes for the headstones along the line he believed was the line between the
property. He relied on stakes that were erroneously placed by Vampire Falls on Bella’s property.
Bella ordered Edward to stop digging and leave her property. However, he was enraged and
almost hit Bella with a shovel. While running for her safety, Bella tripped and broke her ankle.
Through her attorney, Bella commenced an action against Vampire Falls and Edward, alleging a
cause of action in trespass and assault and seeking damages for pain and suffering due to her
broken ankle and the cost of restoring and reseeding her property.
Issues
Could Vampire Falls be liable for invading Bella’s property and the resulting damages? On what
theory could Vampire Falls be found liable?
Rules/Theories
The cause of action for damages caused by an entity on an individual or property is based on one
or more theories of liability. The theory of strict tort that results from trespass and negligence is
applicable in the assessment of property and tort liability. The tort of trespass to land occurs
when a person does an act that causes entry into another person’s land without permission or
justification (Dorfman & Jacob, 2015). The trespass does not need to cause any harm to the land
for the tort to be committed.
