A judge is supposed apply the law both fairly and equally. They are not supposed to draw
conclusions about a criminal defendant without first hearing the evidence and if they have
preconceived notions about a criminal defendant than they should be recused from the criminal
case. Judges are public official’s that have not only a legal and ethical obligation to ensure the
equal distribution of justice but a moral one as well. When a judge violates this moral, legal, or
ethical obligation a breach of trust has occurred and the integrity of the judiciary has not been
uphold.
Members of the court have a legal and ethical obligation to report any biased actions
involving the criminal court judge. Even if an individual is only an intern they have a
responsibility to report this behavior to the judicial disciplinary board. Judicial independence is
predicated on "good faith" decision-making (). When a judge is making poor judgment that result
in a criminal defendants due process right being violated justice has not been served. Members of
the court will be faced with many ethical dilemmas and the response should be to do what was in
not only ethical and moral but what is just.
