Racial profiling involves a traffic stop conducted by the police based solely on the race of the
individual. The police become suspicious of the individual because they are African American or
some other race and not because of probable cause or reasonable suspicion. The police use
discretion when conducting their duties. They must determine the suspects and determine the
appropriate course of action. Racial profiling is a matter of both ethics and a part of the
discretion powers of the police.
The police are trained to handle many different circumstances when they are in the field but
not every possible incident can be trained for. The police have to use discretion in how they
handle these situations. When the police use discretion to target a particular racial group it
becomes racial profiling. Discrimination based on race, ethnicity, religion, nationality or on any
other particular identity undermines the basic human rights and freedoms to which every person
is entitled (AIU, 2010).
Racial profiling, in the viewpoint of law enforcement, is a necessary tool for identifying
criminal suspects (Callahan & Anderson, 2001). In order for the police to determine a criminal
suspect they must create a profile. The problem is in the high number of traffic stops that are
conducted including individuals from minorities. One familiar term in America is “Driving while
Black”. This means if you are African American you stand a greater chance of being pulled over
than if you were a White American. Law enforcement claims this is due to high number of
African Americans transporting drugs in the vehicles. Since most minority members who are
stopped are not carrying illegal drugs, and resent being stopped and questioned (Garlikov, nd).
The public then loses trust in the police and become suspicious of their intent.
