I believe that tort law furthers public policy in many ways. Technically public policies
define what is good and bad in a given jurisdiction. In this way, individuals are guided on what is
expected of them in close reference to the public administrative policies in place. Consequently,
they understand the consequences they will have in case they indulge in actions that contravene
these policies (Suzanne, 2019). In the same spirit, tort law exists to further public policies in
assigning societal duties to people and agencies, examine the legal implications of their actions,
distribute the burden of liability among parties, and stipulate the retributive measures that will be
slapped against any form of contravention.
In the case of Hardwick v. 3M Company et al., tort law serves to protect public health.
The defendant in this case is accused of willingly hurting the health of many Americans through
blood contamination (Zabinski & Black, 2020). In the context of the case, the defendant will
learn the implications of its public health policy contraventions if found guilty by the Ohio court.
Therefore, the tort law could have furthered public health policies through establishing liability
and the respective punishment that all PFAS manufacturers in the country. The court dismissed
all efforts to have the case dropped by the based on the plausibility of the complainant’s claims.
This assertion by the court is based on the fact that such a contravention could have undermined
all public health protocols in the country. Thus such actions should warrant liability on the part
of the defendant.
