Policy Analysis for FL S0594 Preemption of Recyclable and Polystyrene Materials
Environmental policies capitalize on conserving natural resources by maintaining an
ecological balance, between human activities and natural resources. Environmental balance
protection is essentially within borders of economic growth, property rights, public health, and
energy production processes. Enacting laws and regulations is the only way that the government
at all levels can influence the process of environmental protection. The FL S0594: Preemption of
Recyclable and Polystyrene Materials is one of the pending bills related to environmental
protection and balance. It was introduced on January 12, 2021, and has approximately 25%
progression. Its proposals are referred to the Environment and Natural Resources; Community
Affairs; Rules. The key sponsors of this bill are Senator Linda Stewart and Senator Tina Polsky.
According to The Florida Senate (2021), the public policy bill on preemption of
recyclable and polystyrene materials advocates for the removal of the local prohibiting laws
related to disposable plastic bags, wrappings, and auxiliary containers, by reapplying for the
acquisition of local laws about the use and sale of polystyrene products to the Department of
Agriculture and Consumer Service (DACS).
Following a departmental analysis on various recyclable materials conducted by the
legislature, the committee felt that having a regulatory policy on these materials is essential to

enhance the welfare of Florida's ecology and economy. The bill necessitates that the department
of environmental protection takes analysis to determine the required set of new regulations
related to auxiliary containers, wrappings, and disposable plastic bags used by most consumers
to carry different products after purchase. The bill proposes that the analysis focuses on inputs
from the state and local government agencies, private operations, citizens and stakeholders, and
evaluate the effectiveness of a national and local regulation policy on this bill. It is assumed that
upon agreement, this bill of the act will take effect on July 1, 2021.
Some of the critical areas that the policy will impact are the department of recyclable
materials as their operations will be analyzed to confirm feasibility, and the polystyrene product
manufacturing organizations whose activities will also be evaluated. The policy can affect most
citizens' usual conduct by establishing regulations related to the plastic bags they use daily to
carry products they purchase from retail ventures (Schlachter, 2019). Private and local agencies
will also be forced to adopt new methods of serving the citizens, in activities such as packaging.
Some of the cost benefits associated with the preemption of recyclable materials include
increased economic security. It will offer the nation a chance to tap on its local resources (Chiu
et al., 15). It will reduce pollution through eliminating the need to collect new raw materials
(Lara, 28). It will also save energy and conserve natural resources by reducing the amount of
waste disposed. Therefore the policy holds the potential for both economic and ecological
benefits.
Although enacting a policy and establishing new regulations on the use and sales of
recyclable plastic polystyrene products is not a guarantee to reduce diverse environmental
impacts, it will help ensure a reduced life cycle effect production-consumption. I support the
