T.M. v. State of Florida
I, ____________, write this opinion to support the majority opinion on the case of T.M. v.
State of Florida.
The majority, in this case, concluded that the curfew rule was unconstitutional and I agree
with this because I have a looser interpretation of the law here. There were some statistical
data represented to demonstrate the city’s interest in reducing juvenile crime behaviour but
those data didn’t prove anything about the effectiveness of the law. Also, it should not come
as neglect on the parent’s part because the law should not have any right to interfere with a
parent’s rights on raising a child.
In this particular case, I did tend to favour the loose interpretation of the laws and rights in
this case. For example, the first amendment undertaking limitations on rights imposed based
on age. I mean, if it’s allowed from the parent, then the first amendment should not impose
restrictions for a minor to be out past curfew. Also, in this case, T.M. is being accused of
something that has not even happened, I mean he hasn’t harmed anyone, or himself, or
anyone’s property.
To me, the factor that did influence my decision and interpretation of the case is simple- the
only issue was that T.M. was out a little late one night. That’s it, it was not like any harm was
done, or someone was injured or killed, nothing of such sort. Second, it’s the right of a
parent- how a parent wants to raise their children, the decision they make for them should
only come from them and the government should not drag itself into this.
